AZZULE LIFESTYLE CO is a registered trademark owned by the company BLUE MARBLE COMPANY, S.L. These Terms and Conditions govern the access and use of “http://www.azzulelifestyle.com” website (hereinafter referred to as the “Website”) owned by BLUE MARBLE COMPANY, S.L. (hereinafter referred to as BLUE MARBLE), with CIF B-54958137 and registered office at C / Primero de Mayo, nº23, CP. 03610, Petrer (Alicante), as well as the services and products offered by BLUE MARBLE under its brand AZZULE LIFESTYLE CO on its website.
BLUE MARBLE offers this website subject to these Terms and Conditions. By visiting the website or using the services or applications of the website, the user accepts these Terms and Conditions.
Access to the website will not require registration of Users. However, in order to be able to contract any of the services offered by BLUE MARBLE, the User registration and acceptance of these conditions will be required before formalizing the payment.
Through the Website, BLUE MARBLE offers to the Users articles of the brand ZZ AZZULE LIFESTYLE CO.
The BLUE MARBLE Terms and Conditions described below define the rights and obligations between BLUE MARBLE and the Users within the framework of the Website. These are the only Terms and Conditions applicable to the use of the Website (without prejudice to the existence of particular conditions for certain services) and to the contracting of orders through the Website, and replace all other conditions, except those previously agreed to and in writing between BLUE MARBLE and the User.
- User data and conduct on the website
In order to purchase the products offered through the Website, it is necessary for the User to register by filling out the registration form available on the Website.
The User shall be responsible for maintaining the confidentiality of the data and information provided and for restricting access to his computer and his passwords to avoid possible unauthorized use.
In the event that the User has reason to believe that his / her data has been brought to the notice of a third party, or if it has been, or is likely to be, used in an unauthorized way, he / she shall immediately inform BLUE MARBLE of the same.
The User must verify that his data is correct and complete and inform BLUE MARBLE of any changes and / or updates to the information provided during the process of the purchase.
BLUE MARBLE reserves the right to deny any attempt to access the website, delete or modify content or cancel orders at its discretion.
- Information about BLUE MARBLE’s products and services
The data found on the website in each description of the products and services, in their photographs, graphic or iconographic representations or videos as well as trade names, trademarks or distinctive signs of any kind, are owned by BLUE MARBLE and have a purely informative function. Therefore, BLUE MARBLE declines any responsibility for the appearance of errors in such information, although it undertakes to make all reasonable efforts to correct as soon as possible said errors or omissions after having been informed of the same.
If the price of the products that the User has requested contains an error, he/she will be informed of this as soon as possible, being given the option to reconfirm the order at the correct price or to cancel it. In the event that it is impossible to contact the User, the order will be considered canceled. If the cancellation of the order occurs after the User has already paid, he/she will be entitled to the full refund.
BLUE MARBLE informs the customer that the number of available units is kept up to date with the stock information available to the company. In no case will BLUE MARBLE intentionally sell more units than it has available.
However, on occasion, and due to reasons beyond BLUE MARBLE’s control, such as human errors or computer systems incidents, the actual number of products available may differ from those offered on the website.
In the event that the product is not available after the order has been placed, the Customer will be informed by email of the total or partial cancellation of the order. The partial cancellation of the order due to lack of availability does not entitle the Customer to the cancellation of the entire order. If, as a result of this cancellation, the customer wants to return the delivered product, he/she must follow the procedure set out under the heading Conditions for Returns and Order Cancellations.
- Orders and terms of sale
The services and products offered through the BLUE MARBLE website are intended for the purchase by Users of the ZZ AZZULE LIFESTYLE CO brand.
In order to be able to contract a BLUE MARBLE order, the User must be over 18 years of age and must have a valid credit or debit card issued by a bank accepted by BLUE MARBLE.
- Price, method of payment and discount codes
Once the purchase form is completed, the User must proceed to the payment stage of the order utilizing the means of payment specified on the Website.
Following the finalization of the payment, the User will receive an order confirmation e-mail, which will include a summary of the purchased items, the requested delivery method and the delivery address.
If at the time of making the payment there is an incident that prevents completion of the payment, the User will receive an automatic payment error message and his/her order will not be processed until the payment is finalized successfully.
The prices of the articles are stated in Euros (€), including taxes and costs of handling and shipping, the amount of which will be indicated at the time of final confirmation of each order.
BLUE MARBLE may periodically offer discount codes to its Users. These discounts may only be applied in accordance with the instructions provided by BLUE MARBLE with respect to each code, and in any case Users may only apply one discount code per order.
- Cancellation of Orders
BLUE MARBLE will accept order cancellations when these are requested before the shipment of same. To cancel, the customer must request it by sending an email to email@example.com.
- Conditions for Returns and Order Cancellations
8.1 Returns due to manufacturing defects
The User may return to BLUE MARBLE, at no cost, only products that show a manufacturing defect. In order to formalize the return, the User must contact BLUE MARBLE at firstname.lastname@example.org, within a period of one month, indicating the product or products to be returned, attaching a photograph and a detailed description of defects identified in the same.
Upon receipt of such communication, BLUE MARBLE will indicate to the User within 3-5 business days, whether or not the return will be accepted. In case of return, BLUE MARBLE will indicate to the User the method of collection or shipment of the defective product to its warehouse, at no cost to the User.
Each product to be returned must find itself in an unused state and with all its labels, packaging and, where applicable, original documentation and accessories that come with it included. If the User does not comply with the above, BLUE MARBLE reserves the right to refuse the return.
Once the product has been received and the existence of a fault or factory defect in one of the ordered products has been verified, BLUE MARBLE will proceed to process the shipment of another product of identical characteristics, at no cost to the User.
In the event that due to lack of stock the shipment of another product of identical characteristics cannot be processed, the amount paid for the purchase of the returned product will be refunded as soon as possible.
The delivery of the product of identical characteristics or the new model that the User chooses, as the case might be, will be made within 3-5 working days from the date on which BLUE MARBLE confirms to the User the replacement of the defective product or the shipment of a new model.
The replacement, the shipment of a new model or the termination of contract will not involve additional expenses for the User.
If the User terminates the contract, BLUE MARBLE will process the refund of the entire amount paid by the User for the purchase of the defective product (including shipping costs).
In the event that the User does not agree with the products received in his order, the User, in accordance with the General Law for the Defense of Consumers and Users, will have a period of fourteen (14) calendar days to return the same, without any penalties and without having to indicate the reasons, but will have to pay the direct cost of shipment of the order to BLUE MARBLE.
To formalize the return, the User must contact BLUE MARBLE at email@example.com, completing the order cancellation form that is attached to these Terms and Conditions as ANNEX 1. Upon receipt of such communication, BLUE MARBLE will indicate the method of shipment of the order to its warehouse, which must find itself in an unused state and with all its labels, packaging and, where applicable, original documentation and accessories that come with it included. Should that not be the case, BLUE MARBLE reserves the right to refuse the return. The refund of amounts paid will be carried out as soon as possible and, in any case, within fourteen (14) days after the date on which the User has notify his decision to withdraw from the contract.
BLUE MARBLE is not responsible for the courier company that the User contracts for the shipment of the return order. In this regard, BLUE MARBLE recommends that the User demands from the courier company a delivery confirmation receipt once the courier has deposited the product at the offices / warehouse of BLUE MARBLE, so that the User has a proof of successful delivery of the Product to BLUE MARBLE.
The costs of returning the order (such as shipping costs through courier companies) will be borne solely by the User.
The product must find itself in an unused state and with all its labels, packaging and, where applicable, original documentation and accessories that come with it included. Should that not be the case or should the product have suffered any damage, the User accepts that the product may undergo a value depreciation or that BLUE MARBLE may refuse to accept its return.
Once BLUE MARBLE receives the order and confirms that it is in good condition, BLUE MARBLE will proceed to refund all the amounts paid by the User.
If the User decides to return the order in full, BLUE MARBLE will provide to the User a full refund of all the amounts paid (including shipping costs).
If the User only wishes to return one or some of the products that were part of the order, BLUE MARBLE will not be able to refund the shipping costs that the User has paid for the entire order.
Whatever the case might be, BLUE MARBLE will refund the amounts paid as soon as possible and, in any case, within 14 calendar days following the date on which the User communicated his decision to withdraw from the contract.
- Time, place of delivery and misplacement
BLUE MARBLE undertakes to deliver the product in perfect condition at the address indicated by the customer in the order form.
BLUE MARBLE will not be responsible for errors caused in delivery when the delivery address entered by the customer in the order form is not accurate or was omitted.
BLUE MARBLE informs the Customer that it is possible for one order to be divided into several deliveries.
The time is merely an approximation, therefore, it is possible that it may vary for logistical reasons or due to force majeure. In cases of delays in deliveries, BLUE MARBLE will inform its customers of the same as soon as it becomes aware of them.
Each delivery is considered to be made from the moment in which the transport company puts the product at the customer’s disposal, which is materialized through the control system used by the transport company.
In the case of delays in the delivery of orders attributable to BLUE MARBLE, the customer may cancel the order. To this end, he/she should contact BLUE MARBLE through email at firstname.lastname@example.org.
Delays in delivery shall not be considered as cases in which the order could not be delivered for reasons attributable to the customer.
If following the passage of 7 business days after the realizing of the shipment of the order, the delivery has not been made, the customer should contact BLUE MARBLE. In the event that the customer fails to do so, following 10 business days after the realizing of the shipment of the order it is returned to our warehouse, the customer will have to cover the costs of shipping and return to the origin of the merchandise, as well as possible associated processing costs.
If the reason for which the delivery was not possible is the loss or misplacement of the package, our carrier will initiate an investigation. In these cases, the response times of our carriers usually range from one to three weeks.
- Product Warranty
BLUE MARBLE warrants that products under the trademark ZZ AZZULE LIFESTYLE CO which are available for sale at www.azzulelifestyle.com are free from defects or latent defects that may render them dangerous or unsuitable for normal use.
The warranty will be invalidated in case of defects or deterioration caused by external factors, accidents or an improper use of the product.
Products modified or repaired by the Customer or any other unauthorized person are excluded from the warranty. The warranty shall not be applicable to conspicuous defects and in cases of product compliance failure, for which any claim shall be made by the customer in question within 14 days after delivery of the products. The warranty will not cover products damaged by improper use.
- Severance Clause
In the event that any Clause in these Terms and Conditions is declared null, the remaining Clauses shall remain in force and shall be construed in the spirit of these Terms and Conditions.
All communications between BLUE MARBLE and the User regarding the contracting of orders through the Website, will be made in writing and in accordance with the communication procedures established in these Terms and Conditions for each particular case.
- Governing Law and Jurisdiction.
These General Conditions are subject to Spanish law. For the resolution of any dispute that may arise, the parties agree to submit themselves to the Courts and Tribunals of Alicante or to the Courts and Tribunals of Madrid, expressly waiving any other jurisdiction that may correspond to them when it is outside Spain.
